1. About FamilyBrain

FamilyBrain ("we", "us", "our") is a family productivity service that operates through WhatsApp messaging. FamilyBrain is operated by FamilyBrain Ltd, a company registered in England and Wales.

By messaging the FamilyBrain WhatsApp number or signing up via our website at familybrain.co.uk, you agree to be bound by these Terms of Service.

2. Eligibility

You must be at least 18 years old to use FamilyBrain. By using the service, you confirm that you are 18 or over.

If you add children's information to FamilyBrain (for example, school events or medical details), you confirm that you are the parent or legal guardian of those children and have the authority to share that information.

FamilyBrain is intended for personal, non-commercial family use only.

3. Free Trial and Subscription

Free trial

FamilyBrain is currently free to use during our early access period. We will give you at least 30 days' notice before introducing any paid subscription.

When a paid subscription is introduced:

Your consumer rights: Nothing in these terms affects your statutory rights under UK consumer law, including the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013.

You agree not to use FamilyBrain to:

5. Your Data

You own the data you submit to FamilyBrain. We process it only to provide the service to you.

We do not sell your data to third parties. We do not use your family's information for advertising.

Deleting your data

You can delete your personal data at any time by sending /delete-my-data to the FamilyBrain WhatsApp number. To request deletion of all family data, use /delete-all-family-data (this requires confirmation from all adult family members).

6. Intellectual Property

FamilyBrain, its name, logo, and underlying software are the intellectual property of FamilyBrain Ltd. You may not copy, reproduce, or distribute any part of the service without our written permission.

Content you submit (messages, documents, photos) remains yours. You grant us a limited licence to process it solely for the purpose of providing the service to you.

7. Availability and Limitations

We aim to keep FamilyBrain available 24/7, but we cannot guarantee uninterrupted service. Maintenance, updates, or circumstances beyond our control may cause temporary unavailability.

FamilyBrain relies on WhatsApp (operated by Meta) and other third-party services. We are not responsible for disruptions caused by those services.

We provide FamilyBrain as a helpful tool, but we are not responsible for decisions made based on information stored or retrieved through the service. Always verify important information (such as medical or legal matters) through appropriate professional channels.

8. Termination

You may stop using FamilyBrain at any time. To delete your account and data, send /delete-my-data via WhatsApp or email hello@familybrain.co.uk.

We may suspend or terminate your access if you breach these terms, or if we decide to discontinue the service. If we discontinue the service, we will give you at least 30 days' notice and provide a way to export your data.

9. Liability

To the maximum extent permitted by UK law, FamilyBrain Ltd's total liability to you for any claim arising from your use of the service is limited to the amount you have paid us in the 12 months preceding the claim (or £50, whichever is greater).

We are not liable for indirect or consequential losses, loss of data (beyond our obligations under the Privacy Policy), or losses arising from third-party service failures.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under UK law.

10. Governing Law

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

11. Changes to These Terms

We may update these terms from time to time. We will notify you of material changes via WhatsApp message or email at least 14 days before they take effect. Continued use of FamilyBrain after that date constitutes acceptance of the updated terms.
